Terms and conditions: Pandas Pay 2 play

The competition will begin on 24 September 2022 between 10 am and 3 pm. No entries submitted after 24 September 2:59 (SAST), will be accepted.

The following individuals are unable to enter this Competition:

  1.  Individuals under the age of 18 in the case winning a television (TV)

Shoppers/Consumers

To participate in this Competition, Participants must purchase Panda store items to the value of R300 or more. Participants can only enter once.

Prize Draw date:24 September 2022

The Competition only takes place at the Panda Stores Cresta Mall on the aforementioned date

Items purchased to enter the competition are subject to EXCHANGE only, contingent on the conditions met by our policy.

Process

  • Customers will pay and if their receipt is R300 or more the attendants will direct people to where the raffle takes place.
  • Customers will come over to the raffle with the receipt as proof.
  • Participants will put on a blindfold and pick a strip of paper for a box and stand a chance to win.
  • A space will be set outside the store in which the draw will take place.

General

  1. The winner will be disqualified and/or the prize will be forfeited if it is determined, in the sole discretion of the Promoters, that the winner was not eligible to win, had not complied with these Rules, had engaged in behavior that could be considered deceptive or fraudulent with respect to the Competition, or if it would be illegal to award the prize. Documents relating to indemnification and prize acceptance may also need to be signed by winners.
  2. The reward cannot be exchanged for another prize, and it cannot be redeemed for cash. The reward will only be given to the verified prize winner; it will not be given or awarded to a third party. Unless the winner is under the age of 18 and has won a television.
  3. Only in compliance with Panda’s exchange policy are prizes subject to exchange.
  4. For whatever reason, the Promoters reserve the right to substitute the prize with any other reward of equivalent or greater commercial value.
  5. By participating, a Participant agrees that the Promoters and their agents will have access to their personal information as needed to administer the Competition and provide prizes to winners.
  6. By participating in this competition, you give the promoters permission to process your personal data for communication or statistical reasons. Your personal information will only be used in compliance with Panda Stores’ privacy policy and current South African data protection laws.
  7. Nothing in these Rules should be interpreted as restricting, limiting, or avoiding any rights or responsibilities that may have been created for either the Participant or the Promoters under the Consumer Protection Act, 68 of 2008, in an unlawful manner (“CPA”).
  8. Every participant takes part at their own risk. By reading and agreeing to these rules, participants agree to these risks and release the promoters, their directors, employees, and agents from any liability related to any damage, cost, injuries, or losses of any kind sustained as a result of their participation in the competition and related events and activities, with the exception of cases in which such damage, cost, injuries, or losses are sustained due to the gross negligence or willful misconduct of the promoters.
  9. Under no circumstances will the Promoters, their directors, employees, agents, or distributors be obligated to pay the Participants or accept liability for: (a) any Participant’s inability to use the prize in full or in part; (b) the poor quality of or any other aspect of any service that is or should be provided at any venue(s) in connection with the prize; or (c) any personal loss or injury sustained at any venue(s).
  10. Neither the prizes themselves nor any warranties or undertakings made by anybody other than the Promoters themselves are subject to any written or verbal misrepresentation on the part of the Promoters, their directors, employees, agents, or distributors.
  11. The Promoter’s reserve the right to end or continue the Competition whenever they see fit. All Participants recognize that, in the event of such termination or extension, they will have no recourse against the Promoters, their advertising agencies, consultants, suppliers, or designated agents and agree to waive (give up) any rights they may have with regard to the Competition.
  12. Participants agree that the Competition will be run in line with the CPA’s rules by participating in the competition. Participants agree to quickly take all steps required to help the Promoters fulfill their obligations under the CPA, including but not limited to promptly supplying any personal information that may be needed to make it easier to award the prize to the Participant. A participant will be judged to have given up the prize if they refuse or are unable to follow this criterion.
  13. The Promoters reserve the right, at any time, and for any reason they deem necessary, to amend, modify, change, postpone, suspend, or cancel this Competition, the Rules, any prize (which has not yet been awarded), or any component thereof, without prior notice. All of the Promoters’ responsibilities with relation to the Competition and the prizes expire at the conclusion of the Contest for whatever reason.
  14. Any Participant and Panda Stores consent to the non-exclusive jurisdiction of the High Court of South Africa, and these Rules shall be governed by and construed in accordance with the laws of the Republic of South Africa.
